Welcome to XclusiveHomez.com (the "Site"), operated by Melody Brown, DBA Xclusive Homez Group ("Xclusive Homez Group," "Company," "we," "us," or "our"). By accessing or using the Site, or by submitting information through any form, chat, or scheduling tool on the Site, you agree to these Terms of Service (these "Terms"). If you do not agree, please do not use the Site.

We may update these Terms from time to time. Continued use of the Site after an update means you accept the revised Terms.

2. Who We Are

Melody Brown is a licensed Texas REALTOR® operating under the trade name Xclusive Homez Group, serving buyers, sellers, and new-construction clients across the Dallas–Fort Worth area. This Site is an informational and lead-generation resource — it introduces our services, shares educational content, displays property listings sourced from third-party feeds, and lets you request information, schedule a consultation, or sign up for updates.

This Site is not a transaction platform. You cannot buy, sell, lease, or close on property through this Site. Real estate transactions are handled directly between you and Melody Brown (and other licensed professionals as applicable), outside of this Site.

3. Eligibility

You must be at least 18 years old to use this Site. By using the Site, you confirm that you meet this requirement and that any information you submit is accurate and current.

4. No Professional Advice

Content on this Site — including blog posts, guides, buyer-readiness resources, and messages from our AI assistant — is provided for general educational and informational purposes only. It is not legal, financial, tax, lending, or investment advice, and it does not replace guidance from a licensed attorney, mortgage lender, financial advisor, or tax professional. You should independently verify any information that affects a real estate or financial decision, and consult the appropriate licensed professional before acting on it.

Property details, pricing, availability, and builder incentives referenced on this Site are subject to change and should be independently confirmed before you rely on them.

6. Property Listings & Data

Property listings displayed on this Site may be sourced from a third-party listings platform and Multiple Listing Service (MLS) data feeds. We do not guarantee the accuracy, completeness, or current availability of any listing. Listing information should be independently verified with Melody Brown or the listing agent of record before you rely on it for any decision.

7. Communications — Email, Phone, and Text Messages

By submitting a form, requesting a consultation, calling, or otherwise providing your contact information, you consent to be contacted by Xclusive Homez Group by phone, email, and text message regarding your inquiry, using the information you provided.

Text messages. If you provide your mobile number, you may receive text messages from Melody Brown directly, from our automated missed-call text-back system, or from our AI assistant, Jade (see Section 8). Message and data rates may apply, and message frequency varies. Consent to receive text messages is never a condition of using our services.

  • Reply STOP at any time to opt out of text messages.

  • Reply HELP for assistance, or contact us using the information in Section 17.

We do not share your mobile number or SMS opt-in information with third parties for their own marketing purposes.

8. Our AI Assistant, "Jade"

Jade is an automated assistant that may respond to messages submitted through this Site or by text, to answer general questions, gather basic information about your timeline and needs, and help schedule time with Melody Brown. Jade is a tool for triage and scheduling — it does not provide legal, financial, lending, or binding real estate advice, and it does not make decisions on our behalf about your transaction. Any matter involving contract terms, financing, or personalized guidance is handled directly by Melody Brown.

9. Acceptable Use

You agree not to:

  • Provide false or misleading information through any form on this Site;

  • Use the Site to harass, impersonate, or misrepresent yourself to us or to any other user;

  • Scrape, crawl, or use automated tools to extract content or listing data from the Site;

  • Interfere with the proper functioning of the Site or attempt to gain unauthorized access to any part of it;

  • Use the Site for any unlawful purpose.

10. Intellectual Property

All content on this Site — including text, graphics, logos, photography, and the Xclusive Homez Group name and branding — is owned by or licensed to us and is protected by applicable intellectual property laws.
