This Privacy Policy explains how Melody Brown, DBA Xclusive Homez Group ("Xclusive Homez Group," "we," "us," or "our") collects, uses, and shares information when you visit XclusiveHomez.com, submit a form, request a consultation, or text or call us (collectively, the "Services").

1. Information We Collect

Information you provide to us. When you fill out a contact, buyer, seller, or booking form, sign up at an open house, or reach out by phone, text, or email, we may collect your name, email address, phone number, and general information about your real estate goals (for example, whether you're buying or selling, your target area, and your general timeline).

We do not collect detailed financial information — such as income, credit history, or debt — through this website or any digital form. That conversation happens directly and privately with Melody Brown as part of working together, not through our website or forms.

Information we collect automatically. Like most websites, this Site collects some technical information automatically as you browse — such as pages viewed, browser and device type, and general location derived from your IP address — through Squarespace's built-in site analytics. This information is used in aggregate to understand how visitors use the Site and is not used to identify you individually.

Text messaging information. If you contact us by text, or provide your mobile number and opt in, we collect your mobile number and the content of your messages in order to respond to you.

2. How We Use Your Information

We use the information we collect to:

  • Respond to your inquiry and connect you with Melody Brown;

  • Schedule and manage consultations and appointments;

  • Send you information you've requested, such as buyer or seller resources;

  • Follow up with you by phone, email, or text about your inquiry;

  • Improve the content and performance of this Site;

  • Meet legal and recordkeeping obligations.

We do not use your information to make any automated decision that produces a legal or similarly significant effect on you.

3. How Your Information Flows Through Our Systems

To keep your inquiry organized and get you a timely response, information you submit moves through a small number of connected systems, in plain terms:

  • Forms you submit on this Squarespace website are sent, through an integration tool called Zapier, into our customer relationship management (CRM) system, GoHighLevel, where your inquiry is logged and routed to Melody.

  • If you inquire about a specific property listing (hosted through our listings provider, Lofty), that inquiry is likewise sent into GoHighLevel through Zapier, so it's tracked alongside any other conversation we're having with you.

  • GoHighLevel is also where our texting, scheduling, and AI assistant (see Section 5) operate.

We do not maintain separate, disconnected copies of your information across these systems beyond what's needed to provide the service described above.

4. Service Providers We Use

We work with the following service providers to operate this Site and respond to your inquiries. Each has its own privacy policy governing how it handles data on our behalf:

We do not sell your personal information to third parties, and we do not share it with anyone outside of the providers above except as described in Section 6.

5. Our AI Assistant, "Jade"

Jade is an AI-powered assistant, built on our GoHighLevel platform, that may respond to messages you send through this Site or by text. Jade can answer general questions, collect basic information about your timeline and goals, and help schedule time with Melody Brown. Information you share with Jade is stored in the same CRM system described in Section 3 and is used only to route and prepare your inquiry for Melody — it is not used to train third-party AI models or shared for advertising purposes.

6. Text Messaging Consent and Opt-Out

If you provide your mobile number, you consent to receive text messages related to your inquiry, including messages from Melody directly, from our automated missed-call text-back tool, and from Jade. Message and data rates may apply, and frequency varies based on your interaction with us.

  • Reply STOP at any time to stop receiving text messages.

  • Reply HELP for assistance.

Your mobile number and text opt-in information are never shared with third parties for their own marketing purposes.

7. Cookies and Analytics

This Site uses standard analytics tools built into the Squarespace platform to understand site traffic. If we begin using additional tracking tools — such as advertising pixels for Facebook, Instagram, or Google — this policy will be updated to reflect that before those tools go live.

8. How We Share Information

We share your information only:

  • With the service providers listed in Section 4, solely to operate the Services;

  • With other licensed professionals (such as a lender, title company, or inspector) if you ask us to make an introduction;

  • If required by law, subpoena, or legal process;

  • If necessary to protect the rights, safety, or property of Xclusive Homez Group or others.

We do not sell your personal information.

9. Data Retention

We retain your information for as long as needed to respond to your inquiry, provide services you've requested, and meet our recordkeeping and legal obligations. You can request that we delete your information at any time using the contact information in Section 12, and we will honor that request except where we're required to retain certain records by law.

10. Your Privacy Choices

Depending on where you live, you may have rights to know what personal information we've collected about you, request a copy of it, request that we correct or delete it, or opt out of certain uses. To make a request, contact us using the information in Section 12. We'll ask for enough information to verify it's really you before we act on the request.

Texas residents: Texas's state privacy law, the Texas Data Privacy and Security Act, generally exempts small businesses as defined by the U.S. Small Business Administration, which likely includes this business. Regardless of that exemption, we will honor reasonable requests to access or delete your information as described above.

11. Children's Privacy

This Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided us information, contact us and we will delete it.
